Terms & Conditions for the BEATIT.TV Online Store

The following terms and conditions shall apply to all orders unless otherwise agreed in writing.

This Terms & Conditions document includes information regarding the Vendor, the Store as well as consumer rights.

§ 1 DEFINITIONS

Working days – Days from Monday through to Friday of each week except public holidays.
User Account – A function of the Store which is free of charge and regulated by separate Terms & Conditions (a service rendered electronically), which allows a Purchaser to start his or her individual User Account at the Store.
Consumer – Consumer as defined by the Polish Civil Code.
Purchaser – Each natural and legal person making a purchase at the Store.
Terms & Conditions – This Terms & Conditions document.
Store – BEATIT.TV online Store operated by the Vendor under https://sklep793283.shoparena.pl.
Vendor – BEATIT SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in ul. Kościańska 41, 60-112 Poznań, Poland, entered into the National Court Register by the POZNAŃ - NOWE MIASTO I WILDA DISTRICT COURT, 8th ECONOMIC DEPARTMENT of the NATIONAL COURT REGISTER under KRS Registration Number 0000724811, tax ID 7811948400, company ID 36740680600000, registered capital PLN 5,00, paid-up capital PLN 5,00.

§ 3 TECHNICAL REQUIREMENTS

  1. For the proper functioning of the Store, the following are required:

  • A device accessing the Internet;

  • An Internet browser for JavaScript and cookies.

  1. In addition to the stipulations of 1 above, an active e-mail account is necessary in order to place an order with the Store.

§ 4 PURCHASE AT THE STORE

  1. Prices shown at the Store are total prices incl. VAT.

  2. The total price of an order is comprised of: article price and delivery costs (if applicable), both of which are shown by the Store.

  3. All articles selected for purchase must be added to cart at the Store.

  4. A Purchaser then selects from the options available at the Store: delivery method and method of payment. A Purchaser also provides all the data necessary to make the delivery.

  5. An order is placed upon confirming its content and accepting this Terms & Conditions document by a Purchaser.

  6. Placing an order is synonymous with entering into a binding contract of sale between the Vendor and the Purchaser.

  7. The Vendor shall send a contract of sale confirmation to the Consumer using a durable medium no later than on the day of delivery.

  8. The Purchaser may register at the Store, i. e. create an individual User Account at the Store, or make purchases with no registration by providing the data necessary to make the delivery each time he or she places an order.

§ 5 PAYMENTS

  1. A Purchaser may choose from the following methods of payment: to pay for an order:

    a. Bank transfer to the bank account held by the Vendor;

    b. Credit/debit card:

    • Visa

    • Visa Electron

    • MasterCard

    • MasterCard Electronic

    • Maestro

c. E-commerce company platforms:

  • Płatności Shoper

  • PayPal

  • Przelewy24

d. Cash on delivery, i. e. full cash payment upon handing a delivery over to the Purchaser;

e. Cash payment upon collection in person.

In the case of selecting the Płatności Shoper e-commerce platform, the provider of online payment services is Blue Media S.A.

In the case of an advance payment by the Purchaser, the order must be paid for within two (2) working days after submitting.

Due to the nature of specific methods of payment, an order may be payable only directly after placing it.

By making a purchase with the Store, a Purchaser accepts the use of electronic invoices by the Vendor. A Purchaser is entitled to withdraw his or her acceptance.

In case a repayment for a payment card transaction made by a Purchaser is required, the Vendor shall make such repayment to the bank account assigned to the Purchaser's payment card.

§ 6 ORDER FULFILLMENT

  1. The Vendor is obliged to deliver articles without defects.

  2. Date of delivery is shown at the Store.

  3. In the case where a Purchaser chooses the advance payment option to pay for his or her order, the Vendor shall commence to process the order after it is paid for.

  4. In the case where a Purchaser makes a single order for many articles with different dates of delivery, the delivery shall be made on the date specified for the article with the longest delivery deadline.

  5. The Store makes deliveries within the territory of:

  • The Republic of Poland;

  • The European Union.

  1. Articles purchased at the Store are delivered depending on the delivery method chosen by a Purchaser:

    a. Courier company;

    b. Polish Post;

    c. InPost;

    d. Electronic – for digital content.

  2. A Purchaser may collect goods in person at the Vendor's office during its working hours.

  3. In case a Purchaser chooses to collect goods in person, the order shall be ready for collection on the date indicated by the Store. In the case where the Vendor has indicated a delivery date, personal collection shall take place on that date.

§ 7 WITHDRAWAL FROM CONTRACT

  1. A Consumer is entitled to withdraw from a contract of sale entered into with the Vendor by mean of the Store without prejudice to § 8 of this Terms & Conditions document within fourteen (14) days for any reason.

  2. The term of withdrawal expires fourteen (14) days after:

    a. The day when a Consumer came into possession of an article or the day when a third party other than the carrier and appointed by the Consumer came into possession of said article;

    b. The day when a Consumer came into possession of the last of the articles purchased or or the day when a third party other than the carrier and appointed by the Consumer came into possession of the last of the articles purchased in the case of there existing an agreement to transfer ownership of multiple articles which are delivered separately;

    c. The day of entering into an agreement – for the provision of digital content.

  3. In order to be eligible for withdrawal from contract, a Consumer must inform the Vendor, using the data provided according to § 2 of Terms & Conditions, of his or her decision to withdraw from contract in the form of a clearly worded statement such as a letter sent by post or information sent via e-mail.

  4. A Consumer may, but is not obliged to, use the Withdrawal from Contract Form Template included at the bottom of this Terms & Conditions document.

    5. In order to keep the term of withdrawal, a Consumer must send notification of his or her decision to withdraw from contract before the term of withdrawal.

    EFFECTS OF THE EXERCISE OF THE RIGHT OF WITHDRAWAL

    6. In the case of withdrawal from contract, the Vendor returns to the Consumer all payments received from the latter including cost of delivery (with the exception of additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest, standard method of delivery offered by the Vendor), and shall do so without delay, no later than fourteen (14) days counting from the day the Vendor received information of the Consumer's decision to exercise the right of withdrawal from contract.

    7. Repayment shall be made by the Vendor using the method of payment chosen by the Consumer for the original transaction unless the Consumer agrees to a different solution. In either case, the Consumer shall incur no cost resulting from such repayment.

    8. The Vendor may withhold a repayment until receiving the article/articles or receiving the proof of the handing in of the item/items (postal or to a courier company), depending on which takes place first.

    9. Articles are to be returned to the following address: ul. Kościańska 41, 60-112 Poznań, Poland. This shall take place without delay, no later than fourteen (14) days counting from the day the Vendor received information of the Consumer's decision to exercise the right of withdrawal from contract. The term of withdrawal is kept if the Consumer dispatches the goods within fourteen (14) days.

    10. The Consumer bears the direct cost of returning the article/articles.

    11. The Consumer is held reliable for diminished value of the article/articles only if it results from using it/them in a way different to that which was necessary to determine the specific characteristics and functioning of the goods.

    12. If, due to its specific characteristics, an article/articles cannot be returned in the normal manner by post, the Consumer shall bear the direct cost of returning the article/articles. The Vendor shall inform the Consumer of the estimated amount of said cost in the description of the article on the Store's website or at the moment of placing the order.

    13. In case a repayment for a payment card transaction made by a Consumer is required, the Vendor shall make such repayment to the bank account assigned to the Consumer's payment card.

§ 8 EXCEPTIONS FROM THE RIGHT TO WITHDRAW FROM CONTRACT OF SALES

  1. A Consumer is not entitled to the right to withdraw from a distance contract of sale in relation to a contract of sale in which:

    a. The subject of the contract of sale is a non-prefabricated article manufactured according to the Consumer's specifications or clearly personalized;

    b. The subject of the contract of sale is an article which is liable to deteriorate or expire rapidly;

    c. The subject of the contract of sale is an article delivered in a sealed packaging, which cannot be returned once the packaging is opened due to health protection or hygienic reasons if the packaging was opened after its delivery;

    d. The subject of the contract of sale are articles which are, after delivery, according to their specific nature, inseparably mixed with other items;

    e. The subject of the contract of sale are audio or visual recordings or computer software delivered in a sealed packaging if the packaging was opened after its delivery;

    f. The subject of the contract of sale is the provision of newspapers, periodicals or magazines, with the exception of the subscription agreement;

    g. The price or remuneration depends on fluctuations in the financial market over which the Vendor has no control, and which may occur before the deadline for withdrawal;

    h. The subject of the contract of sale is the provision of digital content which is not supplied on a tangible medium of digital content that is not stored on a tangible medium if the performance has begun with the express consent of the consumer before the deadline to withdraw from the contract and after the trader has informed him or her of the loss of the right of withdrawal.

  2. The right to withdraw from a distance contract shall not be granted to a consumer other than the Consumer.

§ 9 COMPLAINTS

  1. In the event of a defective article, the Purchaser has the right to lodge a complaint on the basis of a warranty or guarantee under the terms of the Civil Code if a warranty or guarantee has been granted.

  2. On the basis of a warranty or guarantee under the terms of the Civil Code, a Purchaser may:

    a. Make a statement about the request to reduce the price;

    b. Make a statement about withdrawal from the contract of sale if the defect of the article sold is significant;

    c. Require the change of article/articles to free from defects;

    d. Require the removal of the defect.

    3. Complaints are to be lodged on the basis of warranty or guarantee to the postal or e-mail address stated in § 2 of Terms & Conditions.

    4. If the processing of a complaint requires the delivery of the article/articles in question to the Vendor's registered office, the Purchaser is obliged to deliver the goods to the Vendor. If it is a Consumer, the same shall happen at the expense of the Vendor. The delivery address is: ul. Kościańska 41, 60-112 Poznań, Poland.

    5. If there is a warranty or guarantee granted for the article/articles in question, information about its existence as well as its conditions is available in the description of the article on the Store's website.

    6. Claims and complaints concerning the functioning of the Store are to be directed to the e-mail address stated in § 2 of Terms & Conditions.

    7. All claims will be adjusted by the Vendor within 14 days since they are made.

    EXTRAJUDICIAL WAYS TO HANDLE CUSTOMER COMPLAINTS AND REDRESS

    8. In case where complaint proceedings fail to bring the result expected by the Consumer, he or she may take advantage of:

    a. Mediation by the Regional Inspectorate of Trade Inspection competent for the Vendor's registered office, which the Consumer shall apply to requesting mediation. In principle, the proceedings are free of charge. The list of Regional Inspectorates is to be found under: https://www.uokik.gov.pl/wazne_adresy.php#faq595;

    b. Assistance of the Permanent Court of Arbitration competent for the Vendor's registered office operating at the Regional Inspectorate of Trade Inspection, which the Consumer shall apply to requesting consideration of the case before an arbitral tribunal. In principle, the proceedings are free of charge. The list of Courts of Arbitration is to be found under: https://www.uokik.gov.pl/wazne_adresy.php#faq596;

    c. Free assistance of the Consumers' Ombudsman competent for the Vendor's registered office;

    d. The ODR platform http://ec.europa.eu/consumers/odr/.

§ 10 PERSONAL DATA

  1. The Vendor is the administrator of the personal data provided by the Purchaser when using the services of the Store.

    2. The Purchaser's personal data are processed mainly based on the contract of sale and for the purpose of fulfilling the contract of sale. The personal data provided shall be processed in compliance with the principles stipulated in the European Data Protection Regulation (General Data Protection Regulation). Detailed information regarding personal data processing performed by the Vendor is included in the Privacy Policy posted on the Store's website.

§ 11 DISCLAIMERS

  1. Providing contents of an unlawful nature by the Purchaser is prohibited.

  2. Each act of placing an order with the Store constitutes a separate contract of sale and requires accepting Terms & Conditions each time. A contract of sale is entered into for the period of and for the purpose of fulfilling the contract of sale.

  3. Contracts entered into on the basis of this Terms & Conditions document are drafted in the Polish language.

  4. Should there arise a dispute with a Purchaser who is not a Consumer, it shall be resolved by the court competent for the Vendor's registered office.

  5. None of the stipulations herein do in any way disable or restrict the Consumer's rights resulting from the provisions of law.

  6. Stipulations concerning articles and contracts of sale apply accordingly to digital content and contracts for the provision of digital content unless Terms & Conditions regulate such issues otherwise.

§ 3 TECHNICAL REQUIREMENTS

  1. For the proper functioning of a User Account, the following are required:

  • An active e-mail account

  • A device accessing the Internet

  • An Internet browser for JavaScript and cookies.

§ 4 ACCOUNT

  1. Establishing a User Account is completely voluntary and dependent upon a Purchaser's will.

  2. The User Account offers a Purchaser additional options such as: access to the history of the orders placed by the Purchaser with the Store, following order status or editing the Purchaser data.

  3. In order to establish a User Account, a submission form available at the Store must be filled in.

  4. Upon establishing a User Account, a contract for an indefinite period between the Purchaser and the Vendor is entered into. The said contract regards the maintenance of the User Account according to the rules specified in this terms & Conditions document.

  5. The Purchaser may at any time cancel his or her User Account without incurring any cost.

  6. In order to cancel a User Account, a resignation must be sent to the e-mail address: info@beatit.tv, which shall result in an immediate cancellation of the User Account as well as the cancellation of the agreement for the maintenance of the User Account.

§ 5 COMPLAINTS

  1. Complaints concerning the functioning of User Accounts are to be lodged to the e-mail address: info@beatit.tv.

  2. The Vendor shall handle complaints within 14 days since they are made.

§ 7 DISCLAIMERS

  1. Providing contents of an unlawful nature by the Purchaser is prohibited.

  2. The contract for the maintenance of a User Account is made in the Polish language.

  3. In the event of significant causes described in 4 below, the Vendor has the right to amend the Terms & Conditions for User Accounts.

  4. Significant causes mentioned in 3 above are as follows:

    a. The need to adapt the Store to the legislation applicable to the operation of the Store;

    b. Improvement of the security of the service provided;

    c. Change in the functionality of the User Account which requires a modification of this Terms & Conditions document;

    d. The Purchaser shall be informed of a forthcoming change to this Terms & Conditions document at least seven (7) days before said change comes into effect by means of an e-mail message sent to the e-mail address attributed to the User Account;

  5. If the Purchaser does not express his or her consent to a forthcoming change, he or she should notify the Vendor of said event by means of an e-mail message sent to the Vendor's e-mail address: info@beatit.tv, which shall result in the termination of the contract for the maintenance of a User Account on the date when the forthcoming change comes into effect or prior to that, if the Purchaser submits such a request;

  6. If the Purchaser does not express his or her objection to a forthcoming change by the date of it coming into effect, it is understood that the Purchaser accepts said change, which in no way excludes the termination of the contract in the future;

  7. Should there arise a dispute with a Purchaser who is not a Consumer, it shall be resolved by the court competent for the Vendor's registered office;

  8. None of the stipulations herein do in any way disable or restrict the Consumer's rights resulting from the provisions of law.

For the newsletter of the BEATIT.TV online Store

§ 1 DEFINITIONS

Newsletter – an online service provided free of charge, by which the Service User receives electronically from the Service Provider previously ordered news regarding the Store including information about offers, special offers as well as new products at the Store.

Service Provider - BEATIT SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in ul. Service User - Each natural and legal person using the Newsletter service.

§ 2 NEWSLETTER

  1. The Service User may voluntarily use the Newsletter service.

  2. The requirements for using the Newsletter service include: an active e-mail account, a device accessing the Internet, the latest version of an Internet browser for JavaScript and cookies.

  3. E-mail messages sent as part of the Newsletter service shall be sent to the e-mail address indicated by the Service User upon signing up for the Newsletter.

  4. In order for the Service User to enter into a contract and sign up for the Newsletter service, the following steps take place:

    a. The Service User states in the appropriate box on the Store the e-mail address he or she wants the Newsletter messages to be sent to;

    b. The Service Provider sends to said e-mail address a message verifying its authenticity, which contains a link for the Service User to confirm his or her will to sign up for the Newsletter. After the Service User has confirmed his or her will to sign up for the Newsletter, a service contract is entered into, after which the Service Provider starts to provide the service to the Service User.

  5. Messages sent as part of the Newsletter service shall contain notice of the possibility to sign out from the Newsletter as well as a link to do so;

  6. The Service User may sign out from the Newsletter without providing any reason, at no cost and at all times, taking advantage of the link mentioned in 5 above or by sending an e-mail to the Service Provider's address: info@beatit.tv;

  7. The Service User using the link to sign out from the Newsletter or sending an e-mail requesting to be signed out from the Newsletter shall result in an immediate termination of the contract for the provision of the Newsletter service.

§ 3 COMPLAINTS

1. Complaints concerning the functioning of the Newsletter are to be lodged to the Service Provider to the e-mail address: info@beatit.tv.

2. The Service Provider shall handle complaints within fourteen (14) days since they are made.

§ 4 PERSONAL DATA

1. The Service Provider is the administrator of the personal data provided by the Service User when using the Newsletter.

2. The Service User's personal data is processed mainly based on the contract and for the purpose of fulfilling the contract. The personal data provided shall be processed in compliance with the principles stipulated in the European Data Protection Regulation (General Data Protection Regulation). Detailed information regarding personal data processing performed by the Service Provider is included in the Privacy Policy posted on the Store's website.

§ 5 FINAL PROVISIONS

  1. The Service Provider reserves the right to change this Terms & Conditions document for important reasons. An important reason is understood as the need to change Terms & Conditions in order to upgrade the Newsletter service or to adapt to new legislation which has bearing on the providing of the service by the Service Provider.

  2. Notification of a forthcoming change to this Terms & Conditions document shall be sent to the Service User's e-mail address given by him or her upon signing up for the Newsletter. This shall take place at least seven (7) days before the change comes into effect.

  3. If the Service User does not express his or her objection to a forthcoming change by the date of it coming into effect, it is understood that he or she accepts said change.

  4. If the Service User does not consent to a forthcoming change, he or she shall notify the Service Provider of said event by means of an e-mail message sent to the Service Provider's e-mail address: info@beatit.tv, which shall result in the termination of the contract for the provision of the Newsletter service on the date when the forthcoming change comes into effect.

  5. Providing contents of an unlawful nature by the Service User is prohibited.
